In the midst of a telecom battle with TSTT over allegations of call blocking, Digicel has gone another step by filing an injunction against the state-owned enterprise.
By Asha JaveedBoth parties are expected to appear in the San Fernando High Court today.
Digicel’s chief executive Kevin White said the lawsuit was served to TSTT on Tuesday night but declined to go into further details.
He made the announcement at a news conference yesterday in Digicel’s MovieTowne store.
TSTT’s corporate communications manager Camille Salandy confirmed receipt of legal notice from Digicel and said the matter would be dealt with by the company’s lawyers.
It is the second legal battle being waged by Digicel in a matter of days.
Last Wednesday, Digicel took the arbitration panel to court seeking a review of its decision with regard to the reciprocity of rates.
Two months ago, the arbitration panel, appointed by the Telecommunications Authority in January, determined that TSTT can insist on reciprocity of rates and it should be between 38 and 53 cents.
Lawyers for both Digicel and the panel appeared before Justice Prakash Moosai in the Port-of-Spain High Court last Wednesday seeking leave of the panel’s latest decision. Leave was granted by Justice Moosai.
Digicel is seeking to have the court set aside the panel’s decision based on an error of law.
